Roger is an experienced trial attorney in state and federal courts. He has tried jury and bench trials in Oregon and Washington state and federal courts. He has also argued cases before state and federal appellate courts and participated in arbitrations throughout the United States. Significant cases include prosecution of complex construction disputes, financial fraud and bad faith claims, defense of personal injury suits and disputes under the Uniform Commercial Code. By preparing thoroughly for a case well in advance of the trial date, Roger often can precipitate settlement and reach resolution without the necessity of trial. However, when trial is required, Roger fully understands the Rules of Evidence, the value of fully preparing witnesses and an orderly presentation of ideas as the key to winning.

Construction Law

Roger is an accomplished construction lawyer with a comprehensive knowledge of construction law. He understands the business implications of legal decisions in the context of construction and strives to provide his clients with the information they need to make smart decisions about the most effective way to resolve any construction challenge. His practice includes contract drafting, negotiation, impact and extra work claims, lien and bond claims, contract disputes and construction defect matters. He represents general contractors, subcontractors, developers, design professionals, owners and lenders. His clients include large sophisticated businesses, small and mid-sized contractors and various design professionals. He also represents material suppliers and manufacturers. Roger is a leader in counseling contractors in managing and development of productivity, loss/impact claims and risk avoidance. He has spoken throughout the United States on construction law and is the past Chairman of the Construction Law Section for the Oregon State Bar. He understands schedules, construction accounting and technical aspects of the work. He can communicate with a foreman, corporate controller, or the chairman of the board.

Real Estate

Real estate transactions and litigation form another part of RogerŐs legal practice. He understands both conveyance and financing transactions as well as legal issues relating to title disputes. Whether buying, selling or refinancing real estate, Roger can provide assistance to any party in a transaction.

Debtor / Creditor Relations

Roger has a thorough understanding of all commercial transactions. He has expertise in the Uniform Commercial Code, commercial common law rights and under the Convention on the International Sale of Goods. He understands secured transactions, sales, warranties and financing instruments and has extensive knowledge of the United States Bankruptcy Code. Roger represents debtors and creditors in work-out agreements, lenders, borrowers, sellers, buyers and manufacturers in all types of commercial transactions.
